1. General

These Promotional Terms & Conditions (“Terms”) apply to all promotions, offers, discount codes, gifts with purchase, competitions and marketing campaigns conducted by Cuisinart Australia ("Promotion"), unless otherwise stated.

By participating in a Promotion, you agree to these Terms and any additional terms specified for the relevant Promotion.

To the extent permitted by law, Cuisinart Australia reserves the right to amend, suspend or cancel a Promotion at any time, subject to any written directions from a regulatory authority (if relevant).

Additional terms and conditions may apply to specific promotions. To the extent of any inconsistency between these Terms and the additional terms and conditions for a specific promotion, the additional terms and conditions for that promotion will prevail.

2. Eligibility

Promotions are available to Australian residents aged 18 years or over unless otherwise specified.

Employees, contractors, agencies and associated companies involved in administering a Promotion may be excluded from participation where applicable.

3. Promotional Period

Each Promotion is available only during the advertised promotional period or during any promotional period outlined in the additional terms and conditions specific to the Promotion.

If a purchase is required to participate in a Promotion, orders made before or after the promotional period will not be eligible, unless otherwise stated.

4. Discount Codes

Unless expressly stated otherwise:

Discount codes must be entered at checkout to be valid.
Only one discount code may be used per order.
Discount codes cannot be applied retrospectively after an order has been placed.
Discount codes cannot be exchanged for cash, credit or gift cards.
Discount codes are non-transferable.
Discount codes may exclude selected products, bundles, spare parts, shipping charges or gift cards.
Discount codes cannot be used in conjunction with any other offers, discounts or promotions, unless specifically stated.

5. Sale Pricing

Sale prices apply only during the advertised periods. No rain checks will be provided for out-of-stock items, unless required by law. If a pricing error occurs, Cuisinart reserves the right to cancel affected orders and provide a full refund. Please refer to our Terms of Use for further information.

6. Gift With Purchase

Where a gift will be awarded at the time of making a purchase:

The gift is available while stocks of gifts last.
One gift is available per qualifying transaction, unless otherwise stated.
Gifts are not transferable, exchangeable or redeemable for cash.
If a qualifying order is returned for a refund, the gift must also be returned in unused condition where reasonably requested.
If a gift becomes unavailable, Cuisinart may substitute a gift of equal or greater value.

7. Bundle Offers

Bundle pricing is only available when all qualifying products are purchased as part of the same transaction. If part of a bundle is returned, any refund may be adjusted to reflect the bundle discount applied at purchase.

8. Cashback or Rebate Promotions

Where a cashback or rebate offer is available:

Claims must be submitted within the advertised claim period and in accordance with any separate terms and conditions that apply.
Proof of purchase may be required and provided in a suitable format as required. Failure to produce the proof of purchase when requested may, in our absolute discretion, result in invalidation of all claims made by a customer and forfeiture of any right to a cashback or rebate offer. Purchase receipt(s) must clearly specify the product purchased, how the product was purchased and that the purchase was made during the advertised claim period but prior to submitting a claim.
Incomplete, incorrect or fraudulent claims may be rejected.
Cashback payments will be processed according to the terms and conditions of the individual Promotion.

9. Competitions and Giveaways

Competitions and giveaways may be subject to separate terms and conditions. Please refer to the relevant terms and conditions for further information.

Where required, permit numbers and additional competition rules will be included within the specific Promotion.

10. First Order Welcome Offer

Where a first-order discount is offered in exchange for subscribing to Cuisinart Australia email and SMS marketing communications:

The offer is available to new subscribers only and will not apply where a customer unsubscribes and resubscribes to receive marketing communications.
The discount may only be redeemed on a first online purchase made through www.cuisinart.com.au.
The offer is limited to one redemption per customer, household and email address.
The discount cannot be applied to previous purchases.
Exclusions may apply, including gift cards, spare parts, selected bundles, promotional products and shipping charges.
The offer is not transferable and cannot be exchanged for cash, credit or any other benefit.
Cuisinart reserves the right to cancel discount codes obtained through fraudulent or abusive activity.
By subscribing, you consent to receive marketing communications from Cuisinart Australia. You may unsubscribe at any time. Unsubscribing will not affect a discount already redeemed.
This offer is subject to any additional terms and conditions outlined in relation to this offer elsewhere.

11. Affiliate and Influencer Discount Codes

From time to time, Cuisinart may provide unique promotional codes through affiliate partners, ambassadors, creators or influencers.

Unless otherwise stated:

Discount codes are valid only during the advertised campaign period.
Codes are non-transferable, exchangeable or redeemable for cash and may not be sold.
Only one promotional code may be used per transaction.
Codes cannot be used in conjunction with other discounts, Promotions or offers.
Certain products, categories or collections may be excluded.
Cuisinart reserves the right to amend or cancel affiliate Promotions at any time.
Affiliate and influencer discount codes are also subject to the conditions outlined in section 4 above.

Affiliate links may generate commission for the referring partner in accordance with their affiliate agreement.

12. VIP Subscriber Early Access Promotions

Cuisinart may offer exclusive sales, product launches or promotional access to email and SMS subscribers.

Participation is subject to the following:

Access is available only to eligible subscribers selected by Cuisinart.
Early access does not guarantee product availability.
Products may sell out before the Promotion is made publicly available.
Promotional pricing applies only during the specified early access period.
Cuisinart may modify, suspend or withdraw early access Promotions at any time.

13. Black Friday, Cyber Monday and Sitewide Sale Events

During major promotional events, including Black Friday, Cyber Monday, EOFY and Boxing Day sales:

Offers are available for a limited time only.
Discounts apply only to participating products.
Products may be excluded at Cuisinart's discretion.
Promotions cannot be applied retrospectively.
Orders cannot be amended once submitted, unless otherwise permitted by Cuisinart.
Stock is limited and available while supplies last.
No rain checks will be provided, unless required by law.
Due to increased order volumes, dispatch and delivery timeframes may be extended.

If a product is advertised incorrectly due to a pricing, technical or administrative error, Cuisinart reserves the right to cancel the order and provide a full refund. For further information, please see our Terms and Conditions of Sale.

14. Gift Card Terms

Where gift cards are offered by Cuisinart:

Gift cards are redeemable exclusively at www.cuisinart.com.au, unless otherwise stated.
Gift cards cannot be redeemed for cash.
Gift cards may be used across multiple transactions until the balance is exhausted.
If a purchase exceeds the available gift card balance, an additional payment method will be required.
Lost, stolen or damaged gift cards may not be replaced.
Gift cards expire three (3) years from the date of issue, unless otherwise required by law.
Any unused balance of a gift card will not be provided as cash.
Redemption of a gift card is subject to any terms and conditions, including those specified on the gift card.

Any refund for an order originally paid using a gift card will generally be issued back to a gift card.

15. Product Review Incentive Terms

From time to time, Cuisinart may offer incentives, rewards, entry into prize draws or discount vouchers in exchange for product reviews.

The following conditions apply:

Incentives are offered in exchange for submitting a genuine review, regardless of whether the review is positive, neutral or negative and the content of the review will not impact any participant receiving an incentive.
Reviews must reflect the reviewer's honest experience with the product.
Receipt of an incentive does not influence whether a review is approved or published.
Cuisinart reserves the right not to publish reviews that are offensive, unlawful, misleading, irrelevant or fraudulent.
Incentives cannot be redeemed for cash, unless expressly stated.
As a condition of participating in a product review incentive offer, you license and grant Cuisinart, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their review (which shall include any material submitted by a participant) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.

16. Promotional Exclusions

Unless otherwise stated, Promotions do not apply to:

Gift cards;
Spare parts and accessories;
Shipping charges;
Commercial or wholesale purchases;
Marketplace purchases (including Amazon, eBay or third-party retailers);
Previous purchases; and
Products specifically marked as excluded from promotional activity.

17. Stacking of Offers

Unless expressly stated otherwise:

Only one promotional offer may be applied per transaction.
Promotional codes cannot be combined with cashback offers, affiliate offers, welcome offers or sale pricing.
Where multiple offers are available, the customer will receive the single offer providing the greatest discount as determined by the checkout system.

18. Social Media Promotions

Promotions conducted through Instagram, Facebook, TikTok, YouTube or other social media platforms are in no way sponsored, endorsed, administered by or associated with the relevant social media platform unless expressly stated otherwise. Participation in the relevant Promotion is dependent on participants following and acting in accordance with the social media platforms’ relevant terms of use. Please refer to the specific terms and conditions for the relevant Promotion, which will outline the social media platform terms of use.

By participating, participants release the relevant platform from any loss or damage or personal injury which is suffered or sustained by a participant, as a result of participating in the Promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.

19. Product Availability

All Promotions are subject to product availability.

Cuisinart does not guarantee stock availability throughout a promotional period and reserves the right to withdraw products from sale without notice.

20. Australian Consumer Law and Liability

Nothing in these Terms, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act (Cth), as well as any other implied warranties under the ASIC Act (Cth) or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Cuisinart (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of any Promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Cuisinart (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Cuisinart’s control); (b) any theft, unauthorised access or third party interference; (c) any entry/claim or prize/reward claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Cuisinart) due to any reason beyond the reasonable control of Cuisinart; (d) any variation in prize/reward value to that stated in any specific promotional terms and conditions; (f) any tax liability incurred by a winner or participant; or (g) taking of the prize/reward.

21. Fraud and Misuse

Cuisinart reserves the right to:

cancel orders;
refuse participation;
withdraw promotional benefits; or
deactivate discount codes

where it reasonably suspects fraudulent activity, misuse of Promotions, unauthorised resale activity or breach of these Terms. Failure by Cuisinart to enforce any of its rights at any stage does not constitute a waiver of those rights. Cuisinart’s legal rights to recover damages or other compensation from such an offender are reserved.

22. Miscellaneous

If any offer or Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of Cuisinart, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any participant; or (b) subject to any written directions from a regulatory authority (if required), to modify, suspend, terminate or cancel the Promotion, as appropriate.

Any cost associated with accessing a promotional website (if required) is the participant’s responsibility and is dependent on the Internet service provider used.

If there is a dispute as to the identity of any participant, the Promoter reserves the right, in its sole discretion, to determine the identity of the participant (if required).

The number of entries permitted or any restrictions on the number of prizes that can be claimed/won will be outlined in the specific terms and conditions relevant to the Promotion or offer.

Cuisinart reserves the right, at any time, to verify the validity of submissions, claims or entries (where relevant) and participants (including a participant’s identity, age and place of residence).

Cuisinart’s decision with regard to any successful claimant or winner is final, and no correspondence will be entered into.
